Project Overview



The attorneys at J. Michael McBride, P.C. frequently represent trustees and those who may be appointed in reorganization cases. These cases include prosecution of preference suits and avoidance actions. We have brought suits on our clients’ behalf to recover funds that were preferentially transferred out of the companies before they were put into bankruptcy in order to recover funds for the benefit of all creditors. Additionally we have represented a Chapter 13 trustee on several more complex recovery actions.

Examples of matters include the representation of:
  • A post-confirmation Chapter 11 trustee suing officers and directors on various causes of action relating to their pre-bankruptcy actions and alleged breaches of their fiduciary duty to the debtor’s company.
  • Several Chapter 7 trustees in all aspects of the case including insider litigation (i.e., pursuit of fraudulent transfers), preference litigation, and claims objections.
  • A trustee in bringing suit against 15 different defendants with various causes of action, all relating to a single piece of real estate.
